Terms of Service

These Terms of Service (“Terms”) govern your use of the website, bookings, tours, rentals, and services provided
by Buffalo Bayou Kayak, a brand operated by Lone Star Kayak Tours LLC (“we,” “us,” or “our”). By booking a tour or
rental, using our website, or providing your information to us, you agree to these Terms. If you do not agree, please
do not use our services.

1. Our Services

We provide guided kayak tours, kayak and equipment rentals, and related recreational activities on and around
Buffalo Bayou in Houston, Texas. Availability, routes, and schedules may change due to weather, water conditions,
staffing, or safety considerations.

2. Bookings and Payment

  • All bookings are subject to availability and confirmation.
  • Full payment may be required at the time of booking unless otherwise stated.
  • Prices are listed in U.S. dollars and may change without notice prior to booking.
  • You are responsible for providing accurate booking information, including the number of participants and a
    valid contact phone number and email.

3. Cancellations, Reschedules, and Refunds

  • Cancellations made at least [48] hours before your scheduled start time are eligible for a full refund or
    reschedule.
  • Cancellations made less than [48] hours before your start time are [non-refundable / eligible for a reschedule
    only].
  • If we cancel a tour due to weather or unsafe conditions, you may reschedule or receive a full refund.
  • No-shows and late arrivals that miss the launch are not refunded.

4. Assumption of Risk

Kayaking and paddlesports involve inherent risks, including but not limited to capsizing, drowning, collision,
weather exposure, wildlife, submerged objects, equipment failure, and physical injury. By participating, you
acknowledge and voluntarily assume all such risks on behalf of yourself and any minors in your party.

5. Waiver and Release of Liability

As a condition of participation, you and each member of your party will be required to sign a separate liability
waiver and release. To the fullest extent permitted by Texas law, you release Lone Star Kayak Tours LLC, Buffalo Bayou
Kayak, and our owners, employees, and guides from liability for any injury, loss, or damage arising from
participation in our activities, except where caused by our gross negligence or willful misconduct.

6. Participant Responsibilities and Conduct

  • You must follow all safety instructions given by our guides and staff.
  • Personal flotation devices (PFDs) must be worn as directed.
  • We may refuse service to, or remove, any participant who is intoxicated, disruptive, or unsafe, without
    refund.
  • You are responsible for any loss or damage to rented equipment caused by misuse or negligence.

7. Age, Health, and Swimming Ability

Minors must be accompanied by a parent or legal guardian, who must sign all required waivers on their behalf. You
confirm that all participants are in adequate physical condition to participate. Certain tours may have minimum age,
weight, or swimming requirements as posted at the time of booking.

8. Weather and Water Conditions

For your safety, we may delay, shorten, reroute, or cancel any tour due to weather, flooding, water flow, or
other conditions. We will make reasonable efforts to notify you in advance using the contact information you
provide.

9. Text Messaging (SMS) Terms

By providing your phone number during booking or check-in, you consent to receive text messages from Buffalo
Bayou Kayak related to your reservation, scheduling, and, where you have opted in, promotional offers.

  • Message frequency varies based on your activity and bookings.
  • Message and data rates may apply.
  • You can opt out at any time by replying STOP. You will receive one confirmation message and
    no further texts.
  • Reply HELP for help, or contact us at [PHONE] or [EMAIL].
  • Carriers are not liable for delayed or undelivered messages.
  • Consent to receive text messages is not a condition of purchasing any service.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which
explains how we collect, use, and protect your information. We do not sell your personal information. Information
collected for text messaging is used solely to deliver the messages described above and is not shared with third
parties for their marketing purposes.

11. Intellectual Property

All content on our website, including logos, text, photos, and graphics, is owned by or licensed to Lone Star
Kayak Tours LLC and may not be copied or used without our written permission.

12. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from your use of our services
will not exceed the amount you paid for the booking giving rise to the claim. We are not liable for indirect,
incidental, or consequential damages.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any
dispute will be resolved in the state or federal courts located in Harris County, Texas.

14. Changes to These Terms

We may update these Terms from time to time. The “Effective date” above reflects the most recent revision.
Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
